Principal Sues Over Fake MySpace Page

A high school principal in Alaska filed a lawsuit against MySpace, Inc. and other unknown users. The lawsuit stems from a fake MySpace page that was created in the principal’s name.

According to news reports from juneauempire.com, the page described the principal as “a drug-using racist with a sexual transmitted disease who insults disabled students and likes books about pornography, anarchy, and the Ku Klux Klan.”

Although the judge assigned to the case dismissed MySpace from the suit, the principal is hopeful the lawsuit will allow her to ascertain the identity of those responsible for posting the fake page.

MySpace was dismissed because the federal Communications Decency Act protects providers from being liable for information posted by users. In addition, MySpace forces users to agree to a terms of use policy, which includes prohibitions on posting under false names.

The lawsuit includes causes of action for defamation and invasion of privacy.

Ali G Lawsuit Dismissed By Judge

A California judge dismissed a defamation lawsuit against actor/comedian Sacha Baron Cohen. The plaintiff, referred to in the case as Jane Doe, claims her name was used in a defamatory manner during a skit for the comedian’s HBO television show. The suit sought $800,000 in damages.

In the skit, Cohen was interviewing writer Gore Vidal about possible amendments to the United States Constitution. Cohen, in character as Ali G, asks Vidal if amendments should be allowed because his girlfriend (who has the same name as the plaintiff) is always “trying to amend herself.”

Judge Terry Friedman, dismissed the case because no “reasonable person” would view the skit as serious. Rather, the skit was clearly a “spoof.” Moreover, as Ali G, Cohen dresses in "ridiculous outfit[s]" and speaks “gibberish.”

Big and Rich Singer Files Defamation Lawsuit

Country recording artist John Rich (of the band Big and Rich) filed a defamation lawsuit against a former reality show contestant who claims Rich punched him at a nightclub.

The defendant was a contestant on the American Idol-esque reality show, “Nashville Star.” During a post show radio interview, the defendant recanted the story of Rich, the show’s host, punching him in the face during an altercation at a nightclub.

Although Rich admitted that the two’s paths had crossed in the past, he claims in the suit that the statements were “false and defamatory when considered in context, and it was comprised of numerous knowingly false and knowingly defamatory statements.” The defendant has allegedly trespassed onto Rich’s property years ago, but has since been directed not to enter Rich’s property.
